Any order taken for a product appearing in the online store of the site www.medunivers.ch implies consultation and prior acceptance of these terms and conditions of sale.

The \"clic\" of validation of the order implies a full acceptance of the present. This "click" has the value of a "digital signature".

Objects

The purpose of the present general conditions is to define the rights and obligations of the parties within the framework of the on-line sale of goods proposed by Medunivers SA to the consumer.

General terms and conditions

Medunivers SA reserves the right to modify its conditions at any time by publishing a new version on its website. The general conditions of sale then applicable are those in force at the date of payment of the order. The customer declares that he/she has read all the general sales conditions and accepts them without restriction or reservation.

Prices

The prices of our products are indicated in CHF including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases (e.g. deliveries outside Switzerland...). These rights and sums do not concern the company Medunivers SA. They are the responsibility of the purchaser (declarations, payment to the competent authorities, etc.). The seller advises the buyer to contact the relevant local authorities for information on these aspects. Medunivers SA reserves the right to modify its prices at any time.

Order confirmation

Contractual information will be confirmed by e-mail to the address indicated by the purchaser on the order form.

Orders

Orders will be processed within the limits of our available stocks. The company Medunivers SA therefore reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, especially in case of supply problems, or in case of difficulty concerning the order received.

Proof of transaction

The computerized registers, kept in the computer systems of the company Medunivers SA in reasonable conditions of security are considered as proof of communications, orders and payments between the parties.

Order forms and invoices are archived on a reliable and durable medium that can be produced as proof.

Payment

The fact of validating your order implies for the purchaser the obligation to pay the price indicated. The card is debited at the time the order is placed.

Product information

Every effort has been made to ensure the accuracy of the information presented on www.medunivers.ch. However, Medunivers SA or its suppliers cannot be held responsible for any consequences, incidents or special damages resulting from electronic transmissions or from the accuracy of the information transmitted, even if Medunivers SA has been made aware of the possibility of such damages.

Product and manufacturer names and brands are used for identification purposes only. Product photos, descriptions and prices are not contractual.

Period of validity and price of the offer

Our prices are valid for one day.

Terms of delivery

Products are delivered to the address indicated by the buyer on the order form and only in the geographical areas we serve.

All products leave our premises in perfect condition. It is the customer's responsibility to inform the carrier of any small traces of impact (holes, crushing marks, etc.) on the parcel, and if necessary to refuse the parcel. A new identical product will then be returned to you free of charge.

The exchange of any product declared, a posteriori, damaged during transport, without that no reserve was emitted with the reception of the parcel, will not be able to be dealt with.

As with any shipment, it is possible for the product to be delayed or lost. In such a case, we will contact the carrier to start an investigation.

Every effort will be made, for as long as necessary, to find the parcel.

If necessary, the seller will be reimbursed by the carrier and will deliver a new identical parcel at its own expense.

We decline any responsibility as for the extension of the delivery periods because of the conveyor, in particular in the event of loss of the products, bad weather or strike.

Delivery problems caused by the carrier

Any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged parcel, broken products...) must be indicated on the delivery note in the form of a "handwritten reserve", accompanied by the customer's signature.

At the same time, the customer must confirm this anomaly by sending a registered letter with acknowledgement of receipt to the carrier within two working days of the delivery date, setting out the aforementioned complaints.

The customer must send a copy of this letter to Medunivers SA, route du Pissot 1, 1847 Rennaz.

Without this report, we will not proceed with any exchange.

Delivery errors

The customer must submit to Medunivers SA, on the day of delivery or at the latest on the first working day following delivery, any claim of error of delivery and/or non-conformity of the products in kind or in quality compared to the indications on the order form.

After this deadline, all claims will be rejected. The formulation of this complaint to Medunivers SA can be made at the address route du Pissot 1, 1847 Rennaz.

Any complaint not carried out in the rules defined above and within the time limits could not be taken into account and will release Medunivers SA of any responsibility with respect to the customer.

In case of error of delivery or exchange, any product to be exchanged or refunded must be returned to Medunivers SA as a whole and in its original packaging in perfect condition.

To be accepted, any return will have to be announced and to have the prior agreement of Medunivers SA, which in case of agreement will forward the parcel to the good address.

Shipping costs are the responsibility of Medunivers SA, except in the case where it turns out that the product does not correspond to the original declaration made by the customer in the right direction of return.

Product warranty

The present provisions cannot deprive the consumer of the legal guarantee which obliges the professional salesman to guarantee him against all the consequences of latent defects of the sold thing.

The consumer is expressly informed that Medunivers SA is not the manufacturer of the products except articles clearly mentioned on www.medunivers.ch and that Medunivers SA is released from any responsibility because of the defective products.

Consequently, in the event of damage caused to a person or a good by defect of the product, only the responsibility of the manufacturer of this one could be sought by the customer, on the basis of information appearing on the packing of the aforementioned product.

All technical items benefit from a minimum one-year contractual warranty, except for consumables. It may be longer for certain products (please refer to product descriptions)

Excluded from this warranty are all products modified or repaired by the customer or by any entity other than the service providers chosen by Medunivers SA.

Right of withdrawal

The right of withdrawal applies only to natural persons.

The consumer has a period of seven calendar days to return, at his expense, the products that do not suit him. This period runs from the day of receipt of the consumer's order. All returns must be notified in advance to Medunivers SA customer service. The product must be returned to Medunivers SA route du Pissot 1, 1847 Rennaz.

Sensitive products (such as DVDs, CDs, BOOKS) cannot be returned or exchanged.

Only products returned in their entirety, in their original packaging, complete and undamaged, and in perfect condition for resale, will be taken back. Any product which will have been damaged, or whose packing of origin will have been deteriorated, will not be refunded, neither taken again, nor exchanged. This right of retraction is exercised without penalty, with the exception of shipping and return costs. In the hypothesis of the exercise of the right of retractation, the consumer has the choice to ask either for the refunding of the versed sums, or the exchange of the product. In the case of an exchange, the forwarding will be done with the expenses of the customer.

In case of exercise of the right of withdrawal, Medunivers SA will make every effort to reimburse the consumer within thirty days.

Rights of use

The use of trademarks present on the site is strictly forbidden.

Force majeure

Neither party will have failed in its contractual obligations, insofar as their execution will be delayed, hindered or prevented by a fortuitous case of force majeure. Force majeure shall be deemed to be any irresistible event or circumstance, external to the parties, unforeseeable, unavoidable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.

The party affected by such circumstances shall notify the other within ten working days of becoming aware of them.

The two parties will then meet within three months, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which performance of the contract will continue. If the case of force majeure lasts longer than one month, the present terms and conditions may be terminated by the injured party.

The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the case law of the Swiss courts: blockage of means of transport, earthquake, fire, storm, flood, lightning, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers.

Partial non-validation

If one or more stipulations of the present terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

Non-waiver

The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general conditions of sale shall not be interpreted for the future as a claim to the obligation in question.

Applicable law

These terms and conditions are governed by Swiss law. This applies to both substantive and formal rules.

In the event of a dispute or claim, the consumer should first contact Medunivers SA for an amicable solution.

Protection of personal data

All the data you give us is used to process your orders. You have the right to rectify, consult, modify and delete the data you have provided to Medunivers SA. This right can also be exercised online.

Disputes

All orders placed through the www.medunivers.ch site imply the customer's acceptance, without any restriction, of the Medunivers SA general terms and conditions of sale.

In the event of a sale to a legal entity, any dispute relating to the sale (price, terms and conditions, products, etc.) will be subject to Swiss law before the court of the registered office of Medunivers SA.
